Continual
Terms of Service
Core service rules for using the Continual Platform, including accounts and API keys, acceptable use, prepaid balance, billing, and support expectations.
Operator And Scope
These terms govern access to the Continual Platform — the API at platform.continualmi.com, the developer console, the prepaid balance that pays for API usage — and to the company site at continualmi.com, all operated by Continual MI, LLC.
Operator
Continual MI, LLC
Support
Address
Continual MI, LLC, United States
Business / Tax Details
U.S. company. Tax details appear on checkout, invoices, receipts, or other required billing records when applicable.
Eligibility And Accounts
- You must use a valid account and provide accurate billing and sign-in information.
- The service is intended for adults aged 18 and over, and for business use.
- API keys are yours to protect. You are responsible for activity performed through your account and your keys unless caused by a service fault or security incident.
- We may suspend or terminate access if an account is used for unlawful activity, abuse, payment fraud, security attacks, or repeated material violations of these terms.
Model Output
- Output is generated by machine-learning models and varies between requests, including for the same input.
- The service can make mistakes, return incorrect or incomplete output, or be unavailable during incidents.
- The operator reserves the right to block or review requests or outputs that are unlawful, abusive, or unsafe.
- You should not rely on generated output as factual, professional, legal, medical, financial, safety, or emergency advice, and you are responsible for reviewing output before acting on it.
Content Rights
You keep any rights you already have in prompts, inputs, and other content you submit, and as between you and the operator you own the output returned for your own requests, subject to applicable law and the rights of other parties. The platform code, models, model weights, interface assets, documentation, and logos remain owned by their respective owners and are licensed to you only for using the service.
By submitting prompts, feedback, support messages, or other account content, you grant the operator a worldwide, non-exclusive license to host, process, display, reproduce, modify, and use that content as needed to operate, secure, troubleshoot, improve, and support the service and to comply with law. Do not submit content unless you have the rights and permissions needed for that use.
Acceptable Use
- Do not use the service for unlawful content, harassment, exploitation, or rights-infringing material.
- Do not attempt to bypass safety, billing, or account controls.
- Do not use the service to generate or distribute content that would be illegal in the target market.
- Do not scrape, overload, reverse engineer, probe, or interfere with the service except where applicable law expressly allows it.
- Do not upload or prompt for sexual content involving minors, non-consensual sexual content, terrorist or violent extremist material, malware, credential theft, fraud, or targeted abuse.
Paid Usage And Balance
- Usage is paid for from a prepaid balance. There is no subscription, no seat, no recurring charge, and nothing that renews.
- A top-up is a one-time purchase that adds balance to the account that completed checkout.
- Balance does not expire and is drawn down only as usage is metered, at the rates published on the pricing page.
- A top-up can be refunded in full on request within 14 days of the transaction date, returned to the original payment method, and the refunded balance is removed from the account.
- Purchases are sold by Paddle (Paddle.com Market Limited, or Paddle.com Inc. for customers in the United States, or Paddle.com (Canada) Ltd. for customers in Canada), our merchant of record, which is the seller and contracting party for the payment itself and issues the invoice or receipt.
- Pricing, currency, and any material purchase terms should be shown before payment is completed.
- Taxes, if any, may be calculated at checkout or shown on the payment receipt depending on the buyer's location and applicable law.
Service Availability And Remedies
The operator should use reasonable care to keep the service available, but outages, model failures, and billing issues can happen. If the paid service is not supplied correctly or is materially defective, you may be entitled to remedies under applicable law, including reperformance, price reduction, or refund depending on the circumstances.
Warranty Limits
To the extent allowed by law, the service is provided as available and without promises that generated content will be accurate, uninterrupted, error-free, or suitable for every use or jurisdiction. Some regions do not allow certain warranty exclusions, so those exclusions apply only as far as local law permits.
Liability Limits
To the extent allowed by law, the operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption. These limits do not exclude liability that cannot legally be limited, including liability for fraud, intentional misconduct, or consumer rights that cannot be waived.
Copyright And Takedown Requests
If you believe content on the service infringes your copyright or other rights, contact support with enough information to identify the work, the allegedly infringing material, your contact details, and a statement that you are authorized to act. We may remove or restrict content and accounts where required or appropriate.
Changes To The Service Or Terms
We may update the service and these terms as the platform, models, billing flows, safety controls, and applicable law change. The updated date at the top of the page identifies the current version. Material changes will be handled with additional notice where required by law.
Governing Law
These terms are governed by the laws of the United States and, where applicable, the state law governing Continual MI, LLC, without regard to conflict-of-law rules. Mandatory consumer protections in your country or state may still apply and are not waived by these terms.
Support And Complaints
Support requests, billing incidents, privacy requests, and complaints should be routed through the listed support contact. Depending on the buyer's location, mandatory consumer or privacy rights may apply in addition to these terms and are not waived by this page.
